A new stage for the creation of societies in Argentina begins. The Executive Power has 60 days to regulate it and it is estimated that it would have practical application from next June.
With the new law 27,349 passed on March 29, and decree 252 published a few days ago (April 12), a new stage for the creation of societies in Argentina begins, which at first glance seems to be much more dynamic and flexible, accompanying the idea of favoring and channeling new investments through the creation of new companies.
The Executive Power has 60 days to regulate
The Executive Power has 60 days to regulate it and it is estimated that it would have practical application from next June.
Until today it was unthinkable to be able to create a society that was operational and able to function in less than a couple of months. Along the way, those who wanted to undertake lost money, customers and opportunities.
And also you gain, energy and confidence in the country, especially when it came to new foreign investments, since in order to obtain the registration of non-resident partners (CDI) it really became a true odyssey. Now it is planned to be obtained in just 24 hours from its presentation via WEB or in person at the premises.
Update the models
The existing models of corporate types to start a business had been created almost 30 years ago, and for some businesses they were no longer attractive when it came to thinking about new ventures. Above all, this happens in such a dynamic and globalized world, so that the birth rate of new companies has been very low.
When foreign investors asked about the deadlines for creating a company in our country, they could not understand the bureaucracy they had to face in front of other countries where the process used to be summed up to no more than a couple of days at the most.
A company in one day
The main novelty that introduces the enforced regulations is that entrepreneurs can create companies in less than a day. The proof of the fiscal domicile that was a stumbling block that is often insurmountable will no longer be necessary and can be accredited within 12 months of the SAS being created.
It also establishes the idea of venturing into the digitization of information, both at registration levels and the statutes and powers.
This new corporate-type model, already in operation together with the Law for the Promotion of SMEs, will facilitate the start-up of new businesses and with financing such as the one provided by the law on entrepreneurs, will be the initial kick for a paradigm shift.
